Facts

Francisco Padilla, a 19-year-old Mexican agricultural worker, was driving down a ranch road in Temecula on April 28, 2003, when he was stopped by Deputy Alexander Todd of the Riverside County Sheriff's Office. Todd, who suspected that Padilla was fleeing the area, questioned Padilla about why he was on the ranch. A physical altercation ensued before Padilla was handcuffed and taken into custody. He was arrested for resisting arrest and not having a registered driver's license. A witness videotape showed Todd striking Padilla as he was being handcuffed.

Damages

Padilla claimed unspecified damages for emotional distress.

Other Information

Upon board approval, Padilla agreed to immediately dismiss Todd from the action and further agreed to promptly dismiss the remainder of the action upon receipt of the settlement payment. The settlement amount was announced later. The settlement amount was presented to the Mexican consulate, which was to wire the money to Padilla, who had previously been deported to Mexico.
