Facts

A mattress was lying across two lanes of Highway 101 in San Francisco, causing defendant Solomon Abrams, a driver for defendant Allied Shuttle, to stop his 15-passenger van. A taxi driven by plaintiff Uluc Turan crashed into the back of the defendant's van, injuring the plaintiff and his passenger, fashion model Reanna Spaulding.

Injuries

Turan suffered multiple fractures to his right leg that required surgery. He will probably suffer from early arthritis. The defendants contended that Turan's weight and arthritic knee made him predisposed to arthritis. Spaulding suffered a broken nose that changed the shape of her face and made her less photogenic. She also suffered a leg injury that prevented her from working out and, thus, caused her to gain weight.

Result

The jury found Allied Shuttle 99 percent responsible and Turan one percent responsible for Turan's injuries. Turan recovered $1.5 million. The jury found Allied Shuttle 74 percent responsible, Turan one percent responsible, and Spaulding 25 percent responsible for Spaulding injuries. Spaulding recovered $382,000. The case has settled for $1 million with $775,000 plus costs to Turan and $325,000 plus costs to Spaulding.
