Facts
The plaintiff is a current employee of SCPMG working at the Kaiser Permanente Medical Center in Anaheim. She has worked for SCPMG since 1998 as an EKG technician, but has applied several times for a transfer to an echocardiogram technologist (echo tech) position. Each time she applied, SCPMG informed her that she was not qualified for the position. SCPMG also told her that she should enroll in the echocardiography program at OCC, a nearby community college, to supplement the education and clinical training she received in an echocardiography program at Pacific College that she attended in 1997. The plaintiff contended that the real reason she was not hired for the position is that she is a woman in her 40s.

The plaintiff demanded $195,000; the defense offered $50,000.

The plaintiff claimed backpay, emotional distress and attendant medical treatment.
