Facts

Eugene and Wauneta Garcia filed suit against the United States alleging that medical staff for the U.S. Department of Veterans Affairs was negligent in treating Mr. Garcia's shoulder. Defendant contended that the staff adhered to the proper standard of care.

The parties settled for $135,000, which was approved Aug. 15, 2008.
