Facts
Brittney Ferrette was born with persistent hyperplastic primary vitreous in her left eye, which leads to permanent blindness if left untreated. Ferrette received surgical intervention to restore vision to her eye. However, the procedure failed. As a result, she sued Dr. Abdoulaye Diop and the A. Diop Family Clinic for medical malpractice.
Contentions
PLAINTIFF'S CONTENTIONS:
Ferrette claimed that the defendants breached their duty of care by failing to recognize her condition in time. As a result of the failure, surgical intervention did not restore her vision.
Injuries
The plaintiff suffered loss of vision.
Result
The parties settled for $450,000.
Other Information
Prior to settlement, summary judgment was granted in favor of defendants Blue Cross of California and Wellpoint Health Network, Inc. on all claims by plaintiffs, and no appeal was filed. Blue Cross and Wellpoint did not participate in the settlement. FILING DATE: Oct. 7, 2005.
