Rabbi Moshe Abady sued Torah Day School of Seattle, in connection with his employment with the institution.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that in August 2013, he entered into a contract with defendant and took the position as Head of School for the institution. Plaintiff alleged that the contract term was for three years commencing on Aug. 1, 2013 through June 30, 2016. However, plaintiff alleged that he was fired prior to the contract term. Plaintiff then sued, arguing that he was unjustly fired. Plaintiff also alleged that defendant failed to comply with the procedures as set forth under the parties' contract. He also accused defendant of defaming him. In addition to defamation, plaintiff asserted claims for intentional infliction of emotional distress and wrongful termination.

DEFENDANT'S CONTENTIONS:
Defendant claimed that the contract required plaintiff to move to Seattle, and provided him with a travel allowance to facilitate the move. Defendant contended that plaintiff's presence in the community was very important. However, plaintiff failed to demonstrate any plans to live in the community and his absence prompted its 11-member board to decide to dismiss plaintiff for cause. Defendant also argued that plaintiff did not abide by the terms of their agreement, and therefore plaintiff's dismissal was justified. Defendant also accused plaintiff of placing the school's accreditation at risk, and placed students at risk.

Settlement Discussions

Abady demanded $995,904 in damages, plus $60,000 in legal fees. The institution offered $21,000 in settlement.

Result

The matter proceeded to arbitration pursuant to Jewish law. Ultimately, the arbitration panel awarded Abady $34,000 in damages.
