On May 22, 1992, Plaintiff Matthew Murphey, a 36-year-old alarm installer, was injured in a solo vehicle accident in a solo automobile driven by 74-year-old Defendant Leon Knopoff. Defendant fell asleep at the wheel and the vehicle left the roadway. The solo vehicle accident occurred on the Lakeville Highway in Sonoma County.

Plaintiff contends that he initially demanded $93,500, raised to $500,000; reduced to $300,000 and again reduced to $200,000 after jury selection (withdrawn) and Defendant offered $20,000, increased to $100,000 (policy limits), increased to $150,000 while the jury was deliberating.
