Facts

On October 12, 1992, Plaintiff, a 21-year-old drugstore shift supervisor, was supervising a delivery when the battery on the pallet jack going up a ramp, failed. Plaintiff tried to assist when the deliveryman indicated that he needed the Plaintiff's help; but the jack rolled backward and caught Plaintiff's hand between the jack and a pole. When Defendant's employee pulled the jack away, Plaintiff's right palm was torn.
