In February 1992, Defendant Champion Pools resealed, repaired, and refinished Plaintiff's pool. Heavy rains caused water to run underneath the pool; this created a differential pressure beneath the pool. As a result, the pool was displaced by the water pressure causing the pool to move or "float".

Defendant contends that it made a 998 offer in the amount of $12,500 and that Plaintiff demanded between $50,000 and $60,000.
