Facts
In 1994, the plaintiff, a 27-year-old disabled student, was attending the defendant East Los Angeles College, a constituent college of the defendant. He wanted to run for president of the Associated Students Organization in the Spring of 1994, but was unable to do so. According to the defendant, the college determined that he was academically ineligible. According to the plaintiff, the president of East Los Angeles College made, what the school has now admitted, an incorrect interpretation of teh LACCD Rule that defines eligibility for Associated Students Organization office. The plaintiff then suffered what he felt was retaliatory conduct. In the Spring of 1996, the plaintiff discovered what he claimed were irregularities in his transcript, unauthorized methods of computing course units and problems with make-up work for those involved in athletic programs. The plaintiff brought this action against the defendant based on breach of contract, negligence and civil rights violations.
