On May 16, 1996, the plaintiff, a 23-year-old student, was seen removing processed film packages from the Price Club self-serve photo bins. She then removed the photographs from their outer packaging and placed them in her purse before exiting the store without paying for the concealed items. The plaintiff brought this action against the defendant based on false arrest, conversion, intentional infliction of emotional distress and malicious prosecution of criminal action.
