Facts

On Feb. 9, 1997, the plaintiff, a 29-year-old cook, was riding his bicycle to work. A group of boys, ages 8-12 were playing soccer between two apartment buildings on the opposite side of the street. The ball was kicked toward the plaintiff unintentionally. The ball hit his bicycle and he fell, breaking his leg. The defendant owned one of the apartment building, but the boys were not tenants of the building. The plaintiff brought this action against the defendant based on negligence.

Injuries

The plaintiff sustained a broken leg.
