Facts
On March 14, 1997, the plaintiff, a first grade teacher, was on her way to jury duty at the Vista courthouse when the defendant ran a red light and crashed into her small car. The impact was severe. The paramedics and the fire personnel had to use the jaws of life to extracate the plaintiff from the car. The plaintiff brought this action against the defendant based on negligence. On the day of defendant's deposition, the defendant agreed to stipulate to liability and not refer to any arguments of comparative fault.
Settlement Discussions
The plaintiff made a C.C.P. º998 settlement demand for $39,999. The defendant made a C.C.P. º998 offer of compromise for $16,500, which was increased to $22,000. The presiding judge in Vista requested that in-house counsel obtain $29,000, which plaintiff would have accepted, but the defendant carrier refused.
