On Aug. 6, 1995, the plaintiff, a 31-year-old commercial driver, was traveling on the Interstate freeway in Southern Louisiana when his vehicle was hit from behind by a bus owned by the defendant.

Settlement Discussions

The plaintiffs made a C.C.P. º998 settlement demand of $900,000. The defendant made a C.C.P. º998 offer of compromise of $400,000.

Injuries

The plaintiff sustained a L5-S1 disc herniation requiring a laminectomy and resulting in residual permanent back and leg pain.

Other Information

This case was originally filed in Los Angeles Superior Court. The defendant removed the case to the USDC and the court granted defendant's motion to transfer it to the Southern District of Louisiana. The case was litigated in California and Louisiana. The defendant stipulated to liability three months before trial and plaintiff's counsel made a motion to change venue back to California since most of the damages witnesses, plaintiff and his experts were in California. The Hon. Tucker Melancon granted plaintiff's motion to transfer and the case went to District Judge Snyder. The defendants then agreed to binding arbitration with a floor of $400,000 and a ceiling of $1 million. The plaintiff was traveling from Southern California to Louisiana to pursue a career as a commercial driver but can no longer pursue that career.
