Facts
The plaintiff, a 56-year-old facilities coordinator for the defendant Kaiser, claimed that she was replaced by a 38-year-old in May 1994. The plaintiff worked for the defendant for 31 years, rising through the ranks to become the facilities coordinator at Kaiser's Harbor City facility. She received numerous pay raises, promotions and commendations. All her performance evaluation were satisfactory until the year prior to her termination. Her immediate supervisor testified that she was ordered to down grade the plaintiff's last performance review. It was then used to justify her termination as part of a reduction in force. The plaintiff brought this action against the defendant based on age discrimination and wrongful termination in breach of contract and breach of covenant of good faith and fair dealing.

According to the plaintiff: The plaintiff made a C.C.P. º998 settlement demand for $500,000. The defendants made a C.C.P. º998 offer of compromise for $25,000.
