Facts

The plaintiff was working on a road resurfacing project and operating an asphalt roller when it was hit by a county transit authority bus making an unsafe lane change. The right side of the bus to collided with the left portion of the asphalt roller. The force of the impact was sufficient to turn the asphalt roller 180 degrees causing it to overturn. The plaintiff was thrown from his operatorÆs seat and was pinned under the asphalt roller. The plaintiffÆs feet were caught between the driver roller and the curb which amputated his right foot. PlaintiffÆs left foot was also crushed, his left arm was shattered into many pieces, an eyelid was lacerated and he suffered other numerous physical and emotional injuries.

Settlement Discussions

$3,870,000 from three defendants. Contribution by the defendant represented by J. Alan Frederick was the sum of $70,000.

Injuries

The plaintiff suffered right foot amputated, surgery on left arm required the placement of metal plates and screws to repair shattered bone. Plaintiff was in the hospital total of 71 days with further surgeries to his arm and leg. Later, plaintiffÆs right leg was removed at about the knee due to chronic infection. Doctors believe that at some point plaintiffÆs left arm will also need to be amputated.

Other Information

The settlement was reached approximately one year and seven months after the case was filed.
