The plaintiff, a 52-year old deputy sheriff, who worked with the MarshallÆs Association, and who had reported a theft of money and filed a prior lawsuit against the County, received discipline and, eventually, was subject to a criminal prosecution. The plaintiff attributed the discipline and prosecution to retaliation for report of the theft, for his prior lawsuit, and for his work with the MarshallÆs Association. The plaintiff eventually retired.

The plaintiff demanded $465,000 and defendant offered $10,000.

Damages

No current medicals were placed in evidnece, with future medicals highly likely. Loss of earnings was left for the court to determine upon a finding of liability. Loss of future earnings was contingent upon court's finding and constructive disharge.
