On April 20, 1994, the claimant, a 54-year-old woman, was stopped in traffic, waiting to make a left turn, when she was rearended by a vehicle driven by an uninsured driver. The rearend impact propelled the claimant's automobile across two opposing lanes, which were unoccupied, and into a driveway, where it impacted a pickup truck. The pickup truck was a total loss. The claimant brought this claim against the defendant insurance company to recover under her uninsured motorist coverage.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $700,000. The respondent insurance company made a series of settlement offers, starting at $100,000.
