Defendant Fiske & Co employed plaintiff Tyrone Johnson as a truck driver in October of 1993. Johnson voluntarily left his position with Fiske in December of 1993. Thereafter, plaintiff sought employment as a truck driver from December, 1993 to September, 1996. In September of 1996, plaintiff Johnson learned from a prospective employer of an adverse employment report submitted by
Fiske.
Settlement Discussions
The plaintiff initially demanded $140,000, reducing that amount to $30,000 at the MSC. The plaintiff further reduced his demand to $20,000 at the outset of the trial. The defendant made an offer of $5,000.

The plaintiff claimed $140,000 for lost wages. The plaintiff also cited unspecified emotional damages.
Other Information
The award verdict was reached one year and five months after the case was filed. [The plaintiff admitted at trial that after he left the employ of defendant he applied for work with at least 8 prospective employers before the defendantÆs adverse DAC report was published (in March of 1994). The evidence also showed that prior to his employment with the defendant, plaintiffÆs license had been suspended on at least three occasions.
