Facts

Plaintiff, a 45-year-old, school councilor, parked at market parking lot, was attempting to put her purchases in the trunk of her vehicle when defendants vehicle (facing plaintiff's vehicle in the lot) apparently rolled into plaintiff's vehicle. When defendant's vehicle rolled into plaintiff, it caused the latter to lurch backward, impacting plaintiff's right leg. Plaintiff, with help from employees of the market, rolled defendant's vehicle back away from plaintiff's car, and placed a block under its wheel to prevent it from rolling forward again. The plaintiff then left a note on defendant's vehicle. Later, she began to experience pain in her right knee and sought medical care. The plaintiff ultimately underwent surgery that removed 5 percent of the meniscus.

Settlement Discussions

Plaintiff demanded $30,000 and defendant offered $3,500.

Damages

The plaintiff had claimed current medicals of $7,382 and undetermined future medicals. The plaintiff claimed no current or future loss of earnings.

Result

MEDIATION: The mediation lasted 3 hours and resulted in settlement.

Other Information

The settlement was reached approximately one year after the case was filed. The three-hour mediation was held before C. David Serena, resulting in the reported settlement.
