Facts

On Sept. 14, 1998, plaintiff was crossing the street when she was struck by defendant's pick-up truck. The accident occurred at the intersection of Pico and Sepulveda in the city of Los Angeles. At the time of the accident, the intersection was controlled by traffic signals. The defendant failed to notice plaintiff in the street as he executed his left turn on a green light. As a result of the impact, plaintiff, a 59-year-old woman, sustained multiple fractures and was transported to a hospital nearby. She underwent several surgeries and post-operatively developed respiratory difficulty and went into cardiac arrest, suffering severe brain damage due to oxygen deprivation. As a result, she is in a persistent vegetative state. At the time of the accident, plaintiff was suffering from cancer.

Settlement Discussions

The plaintiff made several demands. The defendants made no offers prior to the mandatory settlement conference.

The plaintiff sustained fractures to her upper sacral ala, acetabulum, superior ramus of the left pubic bone, mid femoral shaft and ribs. Additionally, she suffered a ruptured spleen and severe brain damage.

Other Information

The settlement was reached nine months after the suit was filed and three days before trial was scheduled to begin.
