In 1997, the plaintiff bought a new 1997 Ford F150. The air conditioning system emitted a musty odor and, after several attempts to repair it, the odor was still there. The engine allegedly had transmission problems which were never repaired. Per the defendant, South Bay Ford only sold the vehicle, it was not involved in any repair attempts. The plaintiff brought this action against the defendant based on the Song Beverly Consumer Warranty Act, i.e., the Lemon Law.

The plaintiff made a settlement demand for $15,000, with plaintiff keeping his vehicle. The defendant made a C.C.P. º998 offer of compromise for $10,000.
