Facts

Plaintiff Gina Weber, 36, was driving her Gas Co. pick-up cab in Palmdale, when she was hit head-on by
defendant Michael Roberts, who had veered into her lane. The defendant was charged with driving under the
influence. He pled no contest to the DUI charge.

Settlement Discussions

Shortly after the accident, the plaintiff made a demand of $15,000 against the defendant's policy, which was not timely accepted, thus "opening up" the policy. Thereafter, the plaintiff's demands ranged from $2.7 million to a pre-trial C.C.P. Section 998 offer of $1,350,000. The defendant made a C.C.P. Section 998 offer of $660,000 before trial, indicating that there was more available if the plaintiff demanded less than seven figures. Following opening statements, the Court urged the plaintiff to reconsider her settlement position and the case settled for the defendant's pre-trial authority of $750,000.
