Facts

Michelle Andresen, 16, was driving her Honda Accord south on Cascade Boulevard in Shasta Lake on Nov. 16, 2001. Ahren Aitchinson was driving a north on Cascade in a utility truck within the course and scope of his employment with the City of Shasta Lake. The two vehicles collided head-on. The CHP Multi-Disciplinary Accident Investigation Team concluded that the utility truck was straddling the center line at the time of impact, although two witnesses testified that Andresen's vehicle had crossed over the center line at the time of impact. Andresen's passenger, 16-year-old Rachael MacCullough, died in the crash.

Settlement Discussions

MacCullough demanded $1,500,000, reduced to $500,000 before trial. The defendants offered $50,000 per Code of Civil Procedure Section 998.
