PLAINTIFF'S CONTENTIONS:
Defendant allegedly advertised its baby products as "clinically proven" to help babies sleep better, when they do not, in fact, do so, as plaintiff and other consumers have experienced. Plaintiff asserted causes of action for violation of Illinois Consumer Fraud Act and unjust enrichment.
DEFENDANT'S CONTENTIONS:
Defendant denied the allegations and asserted various affirmative defenses.
Result
Johnson & Johnson agreed to settle the dispute for $5 million, which would provide eligible class members with $3 per product without proof of purchase up to $15. Eligible members with proof of purchase may receive up to $30.
