Plaintiff was an inmate at a Los Angeles County jail. He brought a federal civil rights lawsuit against several defendants.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiff contended that he was a helpless schizophrenic who suffered a brutal beating by deputies of the Los Angeles County Sheriff's Dept. He claimed that he was placed in handcuffs and wrist chains, and then beaten, kicked, and pepper-sprayed until he became unconscious. Plaintiff asserted that he did not provoke the deputies in any way and was compliant. Even so, the sheriff's deputies still beat him, covered their tracks, and then falsely accused plaintiff of attacking them.
Plaintiff asserted causes of action for violation of the Bane Act (California Civil Code Section 52.1) and violation of 42 U.S.C. Section 1983.
DEFENDANTS' CONTENTIONS:
Defendants denied wrongdoing and asserted various affirmative defenses.
Result
Plaintiff settled with the Sheriff's Department for $250,000.
