Facts

The plaintiff, a 51-year-old administrative assistant, treated with defendant gynecologist for eight years for both gynecological and family practice needs. In December 1994, plaintiff complained of a lump in her right breast. The defendant doctor told plaintiff to follow-up with him in a few months. The plaintiff presented herself to defendant radiological hospital who failed to document her complaint of a right breast lump. In February 1995, plaintiff again complained to defendant doctor of the lump. The defendant doctor told plaintiff that it was most likely tuberculosis. In 1995, eight months later, defendant doctor referred her to an oncologist. In Septemer 1995, plaintiff was diagnosed with right breast cancer. The plaintiff brought this action against her doctor and the hospital based on a medical negligence theory of recovery.
