Facts

Plaintiff Armando Herrera was employed as a revenue supervisor in the defendant City of Redondo Beach Treasurer's Department. On July 25, 1995, the City Council voted, in a public session, to eliminate that position in the Treasurer's Department. The plaintiff filed a petition for a writ of mandamus based on the job elimination asserting violation of free speech and retaliation.
