Facts

On Jan. 29, 1997, plaintiff, a 38-year-old grocery clerk, was driving his motorcycle eastbound on Balboa in Newport Beach. Defendant was parked along right curb on eastbound Balboa, pulled away from the curb and moved quickly to the left to make a left turn. The plaintiff ran into the driver's side of defendant's car and was thrown over the hood of the car and onto the pavement. The plaintiff brought this action against the defendant based on a negligence theory of recovery.

Settlement Discussions

The plaintiff made a settlement demand for $970,000. The defendant offered $330,000.
