On Dec. 8, 1994, plaintiff Robert Younkin, a 43-year-old plumbing contractor, was driving southbound on Topanga Canyon Boulevard. He had to brake quickly to avoid a three-car accident ahead. Defendant Miklos Steingiesser, following behind plaintiff, was unable to stop in time and rear-ended plaintiff's pick-up truck. Defendant described the impact as moderate. Plaintiff described the impact as heavy. The plaintiff brought this action against defendant based on a negligence theory of recovery.
