Facts

On April 18, 1995, plaintiff George Ebejer, a 57-year-old construction worker, presented to defendant Siskiyou General Hospital complaining of neck pain extending to his head. Defendant Dr. Neil Joyce determined plaintiff was suffering a cervical spasm and sent him home. The plaintiff had headaches through that night and fell into a coma before the next morning. The plaintiff had suffered a subarachnoid hemorrhage and hydrocephalus. On April 19, 1997, plaintiff underwent a ventriculostomy and rehabilitation at a medical center in Medford, Ore.. The plaintiffs, husband and wife, brought this action against defendants based on medical negligence and loss of consortium theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $500,000 to defendant doctor and $200,000 to defendant hospital. The defendants made no offers.
