On Jan. 5, 1996, plaintiff Alice Louise Goldis, a 72-year-old temporarily unemployed secretary, was driving on Main Street in Salinas when she was rear-ended by defendant John Spadaro's truck. Plaintiff alleged the impact was moderate and there was no damage to plaintiff's 1986 Honda. Plaintiff claimed there were some marks on defendant's truck bumper. The plaintiff brought this action against the defendant Spadaro individually and dba Spado's Restaurant based on a negligence theory of recovery. The defendant admitted liability
