Plaintiff Olimpia, Whelan and Lively was a law firm that represented defendant Francesca Lambetecchio in a wrongful termination case pursuant to a contingency fee agreement. The case ultimately settled and the law firm sued for its fees. The plaintiff contended it tried to consult with a lawyer hired by the plaintiff as a consultant but defendant refused to permit it. Plaintiff further contended that defendant thereafter fired the law firm. The plaintiff also contended it had incurred $120,000 in fees in representing defendant and obtained a settlement offer for her of $300,000. The defendants contended she was abused by a partner in the firm, forcing her to leave. She further contended that plaintiff refused to continue to represent her. She also contended her case was settled by another attorney for more than the offer obtained by plaintiff law firm.
