Facts
The plaintiff, Francina Lozado-Nur, is a 47-year-old professor of oral medicine. She is a clinical faculty member and researcher at the University of California, San Francisco School of Dentistry, where she had worked for 17 years. In 1993, plaintiff sought a tenured position at the School of Dentistry but was denied. She brought this claim against defendants Regents of the University of California and UCSF alleging sex and national origin discrimination. The plaintiff contended that defendants wrongfully denied her a tenured position and an accelerated pay raise because of her national origin (plaintiff was originally from Venezuela) and her gender. The defendants contended that the position was never filled because none of the applicants were qualified. The defendants further contended they did not discriminate against plaintiff in their search to fill the position.
