On April 28, 1995, plaintiff Linda Bostic, a 47-year-old card dealer, was driving her vehicle on Vance Street in Chula Vista, when her car struck the driver's side of a pickup truck being driven by defendant Maria Gorman. The plaintiff contended that defendant made an unsafe U-turn and did not see the plaintiff driving up Vance Street. The defendant denied liability contending that she had pulled out of a driveway and that plaintiff must have been speeding. The plaintiff brought this action against the defendant based on a negligence theory of recovery.

The plaintiff made no statutory settlement demands. The defendant made a C.C.P. º998 offer of compromise for $17,500.
Injuries
The plaintiff claimed that she suffered bilateral carpal tunnel syndrome, requiring median and ulnar release surgery; cervical strain; headaches; contusions to the knees; and a laceration to the left side of the head. The defendant disputed the causation of plaintiff's carpal tunnel syndrome, since she had dealt cards for 20 years before the accident.
