Miguel Escalante was pulling out of a shopping center on Cedar Boulevard in Newark. He had pulled out across two lanes of traffic and was attempting to make a left turn, when Duane Hood's Volkswagen Jetta hit Escalante's Ford in the left front corner. Hood sued Escalante, alleging vehicular negligence.
