Facts

Plaintiff Sharon Pedro had a sister-in-law who owed money to Providian National. Defendant Risk Management Alternatives Inc. was attempting to collect the debt. Defendant called plaintiff's home from July 2000 to January 2001. Plaintiff repeatedly told defendant that she was estranged from her sister-in-law, who did not obtain permission to use plaintiff's telephone number. Plaintiff then sent a letter to defendant demanding that the phone calls stop because they upset her husband, who had a heart condition. Plaintiff's husband died in January 2001. On the day before the funeral services, Plaintiff received another phone call from defendant. Plaintiff sued defendant under the Federal Fair Debt Collections Practice Act.

Injuries

Plaintiff claimed that she suffered emotional distress, with symptoms including crying, vomiting, sleeplessness and concern.
