The plaintiffs sued on a variety of federal/state constitutional and statutory grounds to enjoin California City's exercise of its eminent domain power over their properties.

Settlement Discussions

A mediation was held on Feb. 11 2004. The plaintiffs demanded $1.3 million for their properties plus attorneys' fees, which then amounted to $400,000. The defendants offered $250,000 for the plaintiffs' properties, with no attorney fees. The plaintiffs later offered to dismiss without prejudice after the denial of their second motion for a preliminary injunction.

Other Information

The defendants' motion to dismiss on younger abstention grounds was granted. Prior to granting defendants' motion to dismiss, the court denied plaintiffs' two motions for a preliminary injunction.
