Facts

James Hart, 78, a retired plumber, was crossing the Sloat Boulevard intersection through a crosswalk, when he was struck by a pickup truck being driven by Dennis Tupper. Hart was walking in the northbound direction approximately 12 feet from the center divider when he was hit. As a result of the impact, Hart was thrown onto the hood of the truck and fell to the ground. Hart sued Tupper, alleging vehicular negligence.

Hart suffered L3 and L4 transverse process fractures, pelvic fractures, a left gluteal hematoma, a splenic laceration with pseudoaneurysm and multiple right forehead lacerations and abrasions. He also developed a staph infection which complicated his rehabilitation and recovery.
