Facts

On May 24, 2001, plaintiff Ulan Mercado, 42, was involved in a four-car accident on the southbound 57 freeway near the 91 freeway. The accident involved a series of rear-endings. The plaintiff sued defendants Martha Austin and Eduardo Pereira, drivers of the third and fourth cars, respectively. The plaintiff contended that the defendants were liable for vehicular negligence. Defendant Pereira denied that his vehicle was responsible for the impact that the plaintiff felt.

Injuries

The plaintiff claimed she suffered soft-tissue injuries to her neck and back. She also claimed radiculopathy to her left arm. The plaintiff was driving a 1966 Ford Mustang, which she claimed lacked a headrest and, thus, made her more vulnerable to injury.
