Facts
On Feb. 12, 2007, Rene Diaz-Vides (Diaz), 68 years old, tried to park his car in a parking space that was reserved for employees of the Social Security Administration (SSA). After being told that he could not park in an employee space, Diaz insisted on parking there. Security guard Austin Liarola, who worked for Nevada Security Innovations Inc., told Diaz that he should leave. When Diaz refused, Liarola subdued Diaz and a struggle between them followed.
Diaz sued Liarola and his employer for assault, battery, false imprisonment, and infliction of emotional distress.
Contentions
PLAINTIFF'S CONTENTIONS:
Diaz claimed that Liarola kicked him after he had dropped to the ground.
Injuries
Diaz claimed arm, leg and head injuries, and emotional distress.
Result
The parties agreed to settle for $30,000.
