Facts
Plaintiffs are non-profit providers of housing to low-income seniors. Plaintiffs own properties in downtown Los Angeles, within the boundaries of the Downtown Center Business Improvement District ("the BID"). The BID, as adopted by defendants under Article XIII of the California Constitution, sought to assess plaintiffs approximately $580,000 over the course of five years for services rendered by the BID.
Contentions
PLAINTIFF'S CONTENTIONS:
Plaintiffs contended that the BID was invalid because it failed to meet constitutional requirements with respect to determining the special benefits received by each property, determining the amount each property was assessed, and distinguishing between the special benefits received by assessed properties and the general benefits received by the public from the BID services.
Result
Settlement in the amount of approximately $580,000 to be paid to plaintiffs over five years as full reimbursement for assessments to paid each year by plaintiffs.
