On October 7, 1991, Plaintiff Louie Lazic, a 38-year-old self-employed painter, was working at Defendant John McAllister's home when he fell through the railing of a deck. Defendant McAllister, who lived in Los Angeles, had hired Seargeant Construction Company to remodel the home which was in Sonoma County. Part of the work included remodeling an existing deck railing so that stairs could be constructed down to a swimming pool.
