Facts

In late of 1979 Defendants completed the construction of Plaintiff homeowners' association's 144-unit condominium project. The units sold for the amounts ranging from $150-450,000 each.

Settlement Discussions

Plaintiffs contend they made a 998 demand of $5,750,000 in March of 1993; Defendant general contractor and its subcontractors settled construction deficiencies with Plaintiff for $3,167,000 and obtained Plaintiff's agreement that settlement with the remaining parties would require releasing the general contractor and its subcontractors; the Defendants developer, architect, and structural engineer settled with Plaintiff for $3,000,000 and released the general contractor and its subcontractors.

Damages

Cost to repair the deficiencies in design and construction, estimated to be $9,362,631.
