Facts

This action arose out of a three-car rear-end collision which occurred on April 18, 1997 on eastbound Rosecrans Avenue in Norwalk. The plaintiff, Norm Coelho, a 55-year-old retired engineer, stopped his 1982 Honda Accord for traffic. Coelho's vehicle was then rear-ended by a 1991 Toyota Tercel driven by defendant Edmundo Quillares, Jr. The defendant, Alison Izumita, driving a 1991 Toyota Tacoma Truck, then rear-ended the Quillares vehicle, which in turn collided with the plaintiff's vehicle a second time. Defendant Quillares claimed, however, that he was at a complete stop and was rear-ended twice by the Izumita vehicle, forcing him into Coelho's vehicle.

Settlement Discussions

The plaintiff made a $15,000 demand to defendants Quillares and $100,000 to defendants Ronald and Alison Izumita. Defendants Quillares offered $4,000 and defendants Ronald and Alison Izumita offered $10,000.

Damages

The plaintiff's medical specials totaled $2,000 - $3,000, with future medical specials in the range of $25,000. The plaintiff also claimed unpaid property damage in the amount of $500.

Injuries

The plaintiff sustained nerve damage to the "supraorbital occipital nerve" requiring repeated cortisone injections and surgery.

Other Information

The jury found both defendant negligent. Awarded no damages based on pre-existing condition.
