The plaintiff was a route driver for Mother's Cookies. While at a Ralphs grocery store, the plaintiff fell 6-8 feet through an elevated display when the shelf on which she was standing flipped.
Settlement Discussions
The plaintiff demanded $750,000 at a pretrial settlement conference. One month before trial, the plaintiff made a C.C.P. Section 998 demand of $500,000. The defendant offered $75,000 and indicated that it might go up to $100,000.
Injuries
The plaintiff suffered a lacerated left shin down to the bone. The laceration became infected. The plaintiff also suffered soft tissue back injury and underwent surgery to fuse L5-S1 as well as arthroscopic surgery on the knee was recommended but had not been performed as of trial.
