On Dec. 9, 1994, the plaintiff, a 13-year-old student and little league softball catcher, was a passenger in an automobile driven by her mother. The plaintiff's mother was driving southbound on South Turkey Road and was attempting to turn left onto Granzella Road when her car was struck from behind by a pickup truck driven by the defendant. The plaintiff brought this action against the defendant based on negligence theories of recovery.
