On Nov. 25, 1996, plaintiff Rachel Cohen, a 40-year-old traditional Chinese medicine doctor, said she was injured when she was arrested in a public ski area in Sheridan Park. She reported that the arrest for trespassing followed an argument she had with a security guard; the guard reportedly was an off-duty sheriffÆs deputy. The District Court dismissed the trespassing charge against her as well as the assault and resisting-arrest charges. The plaintiff brought suit against three defendants based on false arrest and malicious prosecution.
