Facts

Plaintiff worked for defendant as a maintenance mechanic for over 10 years. He was routinely exposed to chemical fumes, dust and vapors at defendant's plant. Although exposures at the plant were within OSHA limits, plaintiff developed chemical sensitivity to vapors and chronic anxiety. Plaintiff was given a light duty assignment, where chemical exposure was minimal, until he was terminated for fighting with another employee. After a peer review reinstated both employees, defendant did not return plaintiff to work.

Other Information

The plaintiff's claim for breach of contract and breach of the implied covenant of good faith and fair dealing were dismissed on summary judgment. The plaintiff voluntarily dismissed his claim for wrongful termination in violation of public policy before trial.
