In June 1998, the plaintiff, a 67-year-old retiree, took his car to defendant for an oil change. He parked in front of the service pit where he was directed by defendant's employee to park. He got out of his car, and as he was walking in the direction of the cashier, defendant's employee backed another customer's vehicle into plaintiff, knocking him to the ground and fracturing his hip. On the same day, the plaintiff underwent hip surgery and had pins placed in his hip. The plaintiff had a successful hip pinning operation. However, he had episodes of pain afterwards and inactivity from pain and limitation of motion.
